How to renew a South African visa

By Shephard Dube, LLB · 8 min read · ·

You must renew a temporary residence visa before it expires, and normally well before. Applications can only be made inside South Africa in the categories the regulations allow, and you may not simply stay in the country while a late application is pending.

How to renew a South African visa

Key points

  • Renew before the visa expires. An expired visa cannot be renewed and the position becomes far harder.
  • Renewals inside South Africa are only possible in the categories the regulations allow, and that has changed.
  • Start well before expiry. Many people are told to apply months ahead, so check the current requirement.
  • A renewal is a fresh application. You must meet the requirements of the category again, not just show the old visa.
  • You may not simply carry on living here while a late application is pending.
  • Overstaying can lead to being declared undesirable, which bars return for a period.

A temporary residence visa issued under the Immigration Act 13 of 2002 has an expiry date on it, and you must apply to renew it before that date. This is the single most important rule in South African immigration practice, and more people lose their status by missing a renewal than by failing any substantive requirement.

Three points follow from it. Renewals inside South Africa are only available in the categories the regulations allow, and which categories those are has changed over recent years. Applications must normally be submitted well before expiry, not in the final week. And you may not simply carry on living here while a late application is pending, because a late application does not cure an expired visa.

A renewal is also not a rubber stamp. It is a fresh application. Home Affairs looks again at whether you still meet the requirements of the category, whether your circumstances have changed and whether your paperwork is in order. Someone who has changed employer, whose course has ended, whose relationship has broken down or whose funds have run out is not simply renewed because they were approved last time.

How a renewal works, step by step

  1. Find your expiry date and count backwards. Work out the date on which you should submit. Different categories have different lead times and the requirement has been revised, so check the current regulations and the Department's published guidance rather than guessing.

  2. Check that your category can be renewed from inside South Africa. Some categories can, some cannot, and the position has changed. If yours cannot, you have to apply at a South African mission abroad, which needs planning and travel.

  3. Confirm you still meet the requirements. Are you still employed by the employer named on your work visa, in the same position? Is the relationship on which your spousal visa rests still in place? Is your study still registered? If the answer to any of these has changed, a renewal on the old basis is not the right application.

  4. Collect the supporting documents afresh. Police clearances, medicals, letters and financial proof usually cannot simply be recycled from the last application. Many documents have their own validity periods.

  5. Book and submit. Applications in South Africa are made through VFS Global, and abroad at a South African embassy, high commission or consulate. Book the appointment early, because appointment availability is itself a common cause of late submission.

  6. Keep your receipt. The acknowledgement of a properly submitted application is what you show if you are asked about your status while the decision is pending. Photograph it and email it to yourself.

  7. Follow up and plan for the outcome. If the renewal is refused you have a limited time to appeal. Read how to appeal a visa rejection from Home Affairs and use the visa rejection appeal letter template.

A worked example

The facts below are illustrative only and are not a real case.

Samuel is a Nigerian engineer in Pretoria on a work visa that expires on 30 November. He is busy and assumes that as long as he applies before the end of November he is fine.

In August a colleague mentions that she was told to submit months ahead. Samuel checks the current guidance and works out that he needs to submit considerably earlier than he had planned. He goes to book a VFS Global appointment and finds the nearest slot is six weeks away. Had he waited until October, he would have been booking into December.

He then discovers a second problem. His employer restructured in March and his job title changed. His visa names the old position. He raises it with his employer, gets a letter explaining the change and a fresh contract, and gets advice on whether the change is significant enough to need a new application rather than a renewal.

He redoes his medical and radiological reports because the previous ones are too old. He gets a fresh employer letter, recent payslips and a bank statement. He submits in mid-September and keeps the receipt on his phone and in his email.

The decision arrives in February, after the old visa's expiry date. Because he submitted a proper application before expiry, and kept the receipt, his position while waiting was defensible. Had he submitted on 28 November, or not at all, he would have been dealing with an overstay instead of a wait.

What to do this week

  1. Look at your visa and write the expiry date in your calendar, with reminders at six months, four months and three months before.
  2. Check whether your category can be renewed from inside South Africa under the current regulations.
  3. Book the VFS Global appointment now. Availability, not paperwork, is what makes most people late.
  4. Check what has changed since the last application: employer, position, address, marital status, course, funds.
  5. Check the validity of your supporting documents, especially medicals and police clearances, and reorder anything stale.
  6. Check your passport expiry. A passport that expires soon limits the visa you can be given.
  7. Cost it. See what immigration costs.

Documents to gather

  • Passport, valid well beyond the period you are applying for, with blank pages
  • The current visa and copies of every previous South African visa
  • Category-specific proof: employer letter, contract and payslips for a work visa; registration letter and proof of fees for a study visa; relationship evidence for a spousal visa; the financial assurance for a relative's visa
  • Medical report and radiological report where required, recently done
  • Police clearance certificates where required, from every country lived in for twelve months or more since age eighteen
  • Proof of medical cover where the category requires it
  • Proof of address in South Africa
  • Bank statements or other proof of means
  • Completed forms, photographs and proof of the fee
  • The acknowledgement receipt once you have submitted

A realistic timeline

Home Affairs processing times vary widely, differ between offices and missions, and have changed repeatedly. Nothing below is a promise. Check the current published position.

  • Getting a VFS Global appointment: often weeks, sometimes longer in busy periods.
  • Refreshing supporting documents: weeks to several months, driven by police clearances.
  • Decision after submission: commonly a few months, sometimes much longer.
  • Appeal after a refusal: several further months on top.

Because the decision can easily outlast the old visa, the date you submit is what protects you, not the date you are approved.

Common mistakes and what they cost

  • Submitting in the last week before expiry. If the current rules require earlier submission, a last-minute application may be rejected outright and you are then out of status.
  • Letting it expire and applying afterwards. An expired visa cannot be renewed. You may not simply stay while a late application is pending. Read what happens if my visa expires while I am in South Africa.
  • Assuming your category can be renewed from inside the country. Which categories may be applied for or changed from inside South Africa has changed. Read can I change my visa status from inside South Africa.
  • Renewing on a basis that no longer exists. If you left the employer named on your work visa, a renewal is the wrong application. Read can my employer sponsor my work visa.
  • Reusing stale medicals or clearances. A refusal on a technicality, and the fee is gone.
  • Losing the receipt. Without it you cannot easily show that you applied in time.
  • Leaving the country while a renewal is pending. Get advice first. Departure can complicate or end the application.
  • Overstaying, even briefly. You can be declared undesirable, which bars your return for a period and damages every future application, including permanent residence. See the permanent residence and citizenship calculator for how gaps affect the count.

If you cannot afford an attorney

You do not need an attorney to renew a visa. You apply yourself through VFS Global in South Africa or at a South African mission abroad, and the requirements for each category are published. The Department of Home Affairs contact centre answers questions on requirements and on the status of a submitted application. University law clinics advise on immigration matters at no charge, and are worth approaching early if you have already overstayed. The South African Human Rights Commission takes complaints about official conduct. Lawyers for Human Rights and the Scalabrini Centre assist refugees and asylum seekers, including with asylum seeker visa renewals. If you are detained for deportation, Legal Aid South Africa on 0800 110 110 helps in detention and deportation matters, and you should read what your rights are if you are detained for deportation. See legal aid.

Frequently asked questions

People ask how early they should apply. Earlier than feels necessary. The required lead time has changed and appointment availability adds weeks on top, so treat six months before expiry as the moment to start. They ask whether they can stay while the renewal is being decided. If you submitted a proper application before expiry and hold the receipt, your position is normally protected while you wait, but this is exactly why the submission date matters. They ask whether they can work while waiting. Generally you may continue on the terms of the visa you held, but do not assume, and keep the receipt with you. They ask whether they can travel. Get advice before leaving, because departure can complicate a pending application. They ask what happens if the renewal is refused. You have a limited time to appeal and the deadline is short. They ask whether repeated renewals help a permanent residence application, and the answer is that an unbroken visa history is one of the things that matters most on the five-year routes. Frequently asked questions

How early should I apply to renew my visa?
Well before expiry. The required lead time is set by the regulations and has changed, and appointment availability adds weeks on top. Treat six months before expiry as the point at which you start gathering documents and book an appointment.
Can I stay in South Africa while my renewal is being decided?
If you submitted a proper application before your visa expired and you hold the acknowledgement receipt, your position while waiting is normally protected. A late application does not have the same effect, and you may not simply stay while one is pending.
Can every visa be renewed from inside South Africa?
No. Renewals and changes from inside the country are only available in the categories the regulations allow, and which categories those are has changed. Check the current position before you plan, because the alternative is applying at a mission abroad.
What if my job or my circumstances changed since the last visa?
A renewal is a fresh application and Home Affairs looks at your current circumstances. If you left the employer named on your work visa, or your relationship or studies ended, a renewal on the old basis is the wrong application. Get advice about which application you actually need.
What happens if my visa has already expired?
An expired visa cannot be renewed. You are out of status and you may be declared undesirable, which bars return for a period. Get advice immediately rather than waiting, and read the guide on what happens if your visa expires while you are in South Africa.
Can I leave the country while my renewal is pending?
Get advice first. Departure while an application is pending can complicate or end it, and re-entry depends on what you hold at the border. Do not book non-refundable travel on an assumption.
Not legal advice. LawMatch is not a law firm and does not provide legal advice. Information is general and may not apply to your situation.

What happens if my visa expires while I am in South Africa?

From the day after expiry you are undocumented. An expired visa cannot be renewed, a new visa usually cannot be applied for from inside the country, and when you leave you may be declared an undesirable person for a period that grows with the length of the overstay.

Immigration

Can I change my visa status from inside South Africa?

Sometimes. The regulations under the Immigration Act allow a change of status from inside South Africa only in the categories they permit, and generally not from a visitor's visa except in limited cases such as the spouse of a citizen or permanent resident. Many people must apply from their home country, and the application must be lodged while the current visa is still valid.

How to appeal a visa rejection from Home Affairs

You appeal a visa rejection by writing to the Director-General within the period stated in the rejection letter, answering every reason it gives and attaching the missing proof. If that fails you can go to the Minister, and after that to court on review. The deadline is short and an appeal does not give you status.

What is an intra-company transfer visa?

It is the simplest work visa South Africa issues: no points test, no labour market test, no qualifications evaluation. In exchange it lasts at most four years, cannot be extended from inside the country, and ties the holder to one employer. The skills transfer plan it requires is the condition employers forget until the audit.
