What happens if my visa expires while I am in South Africa?
By Shephard Dube, LLB · 9 min read · ·
From the day after expiry you are undocumented. An expired visa cannot be renewed, a new visa usually cannot be applied for from inside the country, and when you leave you may be declared an undesirable person for a period that grows with the length of the overstay.
Key points
- A visa cannot be renewed after it has expired. Renewal must be applied for while it is still valid.
- Once undocumented, applying for a new visa from inside South Africa is normally not allowed.
- Overstaying leads to a declaration as an undesirable person for a period set in the regulations, which is longer for longer overstays and bars re-entry.
- An appeal against the undesirability declaration exists and has time limits.
- Undocumented persons can be arrested, detained and deported. Legal Aid South Africa on 0800 110 110 helps in detention matters.
- If you cannot renew in time, leaving before the expiry date keeps your record clean.
If your visa expires while you are in South Africa, you become an undocumented foreigner from the day after the expiry date. You are then in the country unlawfully under the Immigration Act 13 of 2002. When you leave, Home Affairs may declare you an undesirable person for a period set in the regulations, which is longer for longer overstays, and that declaration bars you from returning for that period. An expired visa cannot be renewed, and in most cases you cannot apply for a new visa from inside the country once you are undocumented. You may also be arrested, detained and deported.
That is the hard version. The practical version is that what you do in the days and weeks after expiry, and ideally before it, changes the outcome a great deal. This guide is about those choices.
The rules in plain terms
Renewal must happen before expiry. A visa is renewed by applying, through VFS Global, while it is still valid. Once the expiry date passes there is nothing to renew. The regulations have required renewal applications to be submitted a set number of days before expiry, so check the current requirement and do not treat the last day as a deadline.
A pending application is not a visa. If you applied for a renewal or a change of status in time and the decision has not arrived by the expiry date, your position depends on the rules on pending applications and on the receipt you were given. That has protected people at some times and not at others, and the position has been the subject of departmental directives and court cases. Keep your VFS receipt and check the current position on the Home Affairs website.
Overstaying leads to undesirability. When you leave South Africa after overstaying, an immigration officer at the port of exit may declare you an undesirable person. The period depends on how long you overstayed, with a longer period for longer overstays. While the declaration stands, you cannot return, and any visa application you make is refused.
You can appeal the declaration. The Act gives a right to apply for the declaration to be reviewed or set aside, and there are time limits. Reasons that have been accepted include serious illness, hospitalisation, a pending application that Home Affairs itself delayed, and other circumstances beyond your control. See how to appeal a visa rejection for the general approach to Home Affairs appeals.
Undocumented persons can be detained and deported. An immigration officer may arrest a person reasonably suspected of being in the country unlawfully. Detention for deportation is subject to time limits and to court involvement, and you have rights during it under the Act and the Constitution of the Republic of South Africa, 1996. Read what are my rights if I am detained for deportation.
What to do if your visa has not expired yet
- Apply for the renewal now, through VFS Global, if you are still inside the window the regulations require.
- If you cannot renew in time, leave before the expiry date. Leaving on a valid visa keeps your record clean and lets you apply for a new visa from home.
- If you want a different category, check whether the regulations allow a change of status from inside the country in your case. Many changes must be applied for from your home country. See can I change my visa status from inside South Africa.
- Keep every receipt and reference number. If Home Affairs has not decided your application by expiry, the receipt is your proof that you applied in time.
What to do if your visa has already expired
If it expired days ago and you have no application pending. In most cases the cleanest option is to leave South Africa as soon as possible. A very short overstay leads to a shorter period of undesirability, and the appeal against it is easier when the overstay is brief and the reason is documented. Do not apply for a new visa inside the country expecting it to cure the overstay. The application is likely to be rejected on the basis that you are undocumented.
If it expired while a properly submitted application was pending. Keep your VFS receipt with you at all times. Check the status of the application and, if it is refused, note the time limit for an appeal. Get advice quickly, because the overlap between an expired visa and a pending application is the area where the rules have shifted most.
If it expired a long time ago. You have three broad options: leave voluntarily and deal with the declaration of undesirability from outside, apply to Home Affairs for the declaration to be waived or set aside if you have grounds, or, if you have a claim to protection, approach a refugee reception office under the Refugees Act 130 of 1998. Working out which applies to you is where a law clinic or an attorney earns their fee.
Whatever the situation, do not use forged stamps or buy a "fixed" visa from anyone. Fraud converts an immigration problem into a criminal one and leads to a much longer ban.
A worked example
The facts here are illustrative only and are not a real case.
Tendai came from Zimbabwe to Johannesburg on a visitor's visa. He found casual work, which the visa did not allow, and let the visa expire in June. In November he is stopped at a roadblock and asked for his papers.
Because he is undocumented, he is taken into custody and told he will be deported. He is entitled to be told why he is being held, to contact family and a lawyer, and not to be held beyond the periods the Act allows without a court's involvement. His cousin phones Legal Aid South Africa on 0800 110 110. Tendai is deported after a short detention, and Home Affairs may declare him undesirable for a period based on his five-month overstay.
Compare a different version. Tendai realises in May that his visa runs out in June. He cannot renew, because a visitor's visa does not permit the work he is doing and he has no basis for a longer stay. He goes home in June, a week before expiry. There is no overstay and no declaration, and he can apply for a work visa from Harare once he has a proper job offer, following which visa do I need to work in South Africa. The difference is a bus ticket and a calendar.
What to do this week
- Find your expiry date. It is on the visa sticker in your passport, and it is the date, not the month.
- Count the days to expiry, or since expiry.
- If there is still time, book a VFS Global appointment or a flight, whichever is realistic.
- If you have applied and are waiting, print the receipt and carry it.
- If you have already overstayed, write down when and why. Illness, a delayed application, a death in the family: get the documents that prove it. They are the basis of an appeal against undesirability.
- Get advice from a university law clinic, Lawyers for Human Rights, the Scalabrini Centre or an attorney before you make a decision you cannot reverse.
Documents to gather
- Passport, including the expired visa and every entry stamp
- VFS Global receipt and reference number for any pending application
- Proof of why you overstayed, if you did: medical records, hospital admission, a death certificate, correspondence with Home Affairs
- Proof of the relationship or the job that would support a new visa application from home
- Police clearance certificates from every country lived in for twelve months or more since age eighteen, medical and radiological reports, proof of funds, marriage certificate and birth certificates, so that you are ready to apply again properly from your home country
- A copy of every document, kept with a family member or emailed to yourself
A realistic timeline
Home Affairs processing times vary widely and change. These are broad ranges only.
- Renewal decided before expiry: possible if you apply early, but not guaranteed, which is why the receipt matters.
- Period of undesirability: set in the regulations by the length of the overstay, from months for short overstays to years for long ones.
- Appeal against undesirability: weeks to many months for a decision.
- Detention pending deportation: limited by the Act, with court oversight required beyond the initial period.
Common mistakes and what they cost
- Treating the expiry date as flexible. One day over is an overstay.
- Applying for renewal too late. A late application can be rejected outright.
- Assuming a pending application cures an expiry. It may not. Keep the receipt and get advice.
- Working on a visitor's visa. It is unlawful in itself, and it undermines any later application.
- Trying to fix an overstay with a new application from inside the country. Usually refused, and you have lost the fee and the time.
- Paying someone to make the problem go away. Fraud is a crime and produces a longer ban.
- Not appealing the undesirability declaration. If you had a real reason for overstaying, the appeal is your route back. Miss the time limit and it closes.
If you cannot afford an attorney
Renewals and new applications are made by you through VFS Global or a South African mission abroad, and the requirements are published. If you are detained, Legal Aid South Africa on 0800 110 110 deals with detention and deportation matters and can act quickly. Lawyers for Human Rights and the Scalabrini Centre assist refugees and asylum seekers. University law clinics give free advice on overstays and undesirability appeals. The Department of Home Affairs contact centre answers questions about the status of an application. See legal aid and what immigration costs.
Frequently asked questions
People ask whether they can pay a fine and stay. No. The overstay is not cured by payment, and the consequence is a declaration of undesirability on departure. They ask whether they will be banned for life. Not for an ordinary overstay. The period is set by the regulations and depends on the length of the overstay, and it can be appealed. They ask whether they can marry a South African to fix it. Marriage gives a basis for a relative's visa, but you still have to apply lawfully, usually from your home country once you are undocumented, and Home Affairs looks closely at marriages entered into after status was lost. See how to apply for a spousal visa. They ask whether an expired visa affects a future permanent residence application. Yes. Gaps in lawful status are examined and can lead to refusal. What are my rights if I am detained for deportation?
If you are detained for deportation you must be told the reason, you may contact a lawyer, your family and your consulate, you may ask that a court confirm the detention by warrant, and you may not be held beyond the period the Immigration Act allows without a court's confirmation. You may also challenge the deportation itself. Phone Legal Aid South Africa on 0800 110 110.

Can I change my visa status from inside South Africa?
Sometimes. The regulations under the Immigration Act allow a change of status from inside South Africa only in the categories they permit, and generally not from a visitor's visa except in limited cases such as the spouse of a citizen or permanent resident. Many people must apply from their home country, and the application must be lodged while the current visa is still valid.

How to appeal a visa rejection from Home Affairs
You appeal a visa rejection by writing to the Director-General within the period stated in the rejection letter, answering every reason it gives and attaching the missing proof. If that fails you can go to the Minister, and after that to court on review. The deadline is short and an appeal does not give you status.

What is an intra-company transfer visa?
It is the simplest work visa South Africa issues: no points test, no labour market test, no qualifications evaluation. In exchange it lasts at most four years, cannot be extended from inside the country, and ties the holder to one employer. The skills transfer plan it requires is the condition employers forget until the audit.
