Representations to the RTIA (dispute an AARTO fine)

A written representation, for attaching to the prescribed AARTO 08 form, asking the Road Traffic Infringement Agency to cancel an AARTO infringement notice. Use it when the vehicle was sold, the notice never reached you, or the facts are wrong.

Representations to the RTIA (dispute an AARTO fine)

Before you fill in a single square bracket, look at the top of the paper in your hand. Two traffic enforcement systems run in parallel in South Africa, and this template works for only one of them. Get that wrong and you spend a week on a careful document the wrong office ignores.

What this document does and when to use it

This is a written representation to the Road Traffic Infringement Agency. Regulation 7 of the AARTO Regulations, 2026 requires a representation to be made on form AARTO 08, completed in black ink, signed and commissioned, with the supporting documents. The form leaves limited space for your reasons and allows additional information on a separate signed sheet, and that is what this letter is: you complete the AARTO 08 and attach this letter as the full statement of your grounds. A representations officer reads it and either finds in your favour on all charges, finds in your favour only on the main charge, or refuses it. If the notice is cancelled because a procedure was not followed, it may be served on you again within the time limits in section 18(1)(b). Lodging a representation costs nothing, but the 2026 regulations add a R100 fee if it is refused. You do not need an attorney, and it is a paper process rather than a hearing.

Which notice do you actually hold? Under the Administrative Adjudication of Road Traffic Offences Act 46 of 1998 (the AARTO Act), the matter is an administrative infringement. The paper uses the word infringement, names the Road Traffic Infringement Agency, carries an infringement notice number and lists your options, one of which is representations. Under the Criminal Procedure Act 51 of 1977 the matter is a prosecution. The paper names a court, and usually a court date or a summons, and the case is dealt with by that court on that day. Representations to the Agency do nothing for a Criminal Procedure Act notice, and the court date does not move because you wrote to somebody else.

Both systems are live, so check every notice individually. As at October 2026, AARTO applies in Johannesburg, Tshwane and about 60 further municipalities added on 1 July 2026, in every province except the Western Cape. Our guide on how to dispute a traffic fine in South Africa walks through the difference.

One thing to leave alone: demerit points. As at October 2026 the points system under the AARTO Act is not in force anywhere, and its start has been postponed more than once, so confirm the current position with the Road Traffic Infringement Agency rather than relying on what you read elsewhere. Our guide on how do demerit points work in South Africa sets out the framework.

Before you send it: get these facts straight

The deadline on the notice. Write it on the front of your file today. Representations sent after the period the notice allows are commonly refused, and the matter then moves on without you.

Which ground is genuinely true for you. The template offers six. You are choosing, not collecting.

Every detail on the notice, transcribed exactly. Notice number, registration number, date, time, place, the description of the infringement and the issuing authority. One wrong digit and nobody can match your letter to the file.

Your documents, not your recollection. The change of ownership notification if you sold the vehicle. A logbook page, job card, rental agreement or tracker report if someone else was driving. Dated photographs of the front, the rear and the plate if the camera image does not match your car. Proof of address if the notice went elsewhere. A hospital record or employer's letter if you rely on circumstances.

The nomination form if you were not the driver. On an AARTO notice the proper route is a nomination on form AARTO 07 within 32 days of service, not a representation, and nomination is not available once a courtesy letter has been issued. Use ground 3.1 only where the nomination window has closed or the nomination was wrongly refused, and attach the evidence, such as a driver nomination affidavit.

And do not pay anything while you wait. Payment is normally treated as accepting the infringement, and it closes this route.

Walking through it, paragraph by paragraph

The heading block is the part people rush and the part that decides whether your letter is findable. It carries the notice number, the registration number, the date and time, the place, the alleged infringement and the issuing authority, all "as stated on the notice". Copy, do not paraphrase.

Paragraph 1 identifies you and makes you choose: "registered owner of the above vehicle" or "person named on the above infringement notice". Delete the one that does not apply. The distinction matters, because a registered owner can ask for redirection and a named driver cannot.

Paragraph 2 gives the date you received the notice and records that you are inside the period it allows. If you are relying on late or defective service, this is where the story starts, and it should line up with ground 3.3 below.

Paragraph 3 is the substance. Six grounds, and you keep only the true ones.

3.1, you were not the driver, is the commonest and the most often botched. It asks for the driver's full name, identity number, licence number and address, and then for the sentence that makes it credible: "I know this because", followed by the logbook, the rental agreement or whatever actually records who had the vehicle. Assertion plus affidavit plus record. All three.

3.2, the vehicle was no longer yours. Give the sale date, the buyer's name and the change of ownership notification. The sale date must be before the date on the notice, so check that first.

3.3, the notice was never served on you. This ground is about an address, so it needs the address on the notice, the date you stopped living there, your address on the vehicle and licence records, and proof. It also asks when and how you found out, which supports the request for fresh service.

3.4, the camera image or details are wrong. The template tells you to "set out the mismatch precisely", and precision is the whole ground. A white sedan against a grey bakkie. A registration number differing by one character. Attach dated photographs and the licence papers.

3.5, the facts are disputed. Short dated sentences about what actually happened, with proof attached: photographs of the obscured sign, a letter placing you elsewhere.

3.6, circumstances that justify cancellation. An emergency, or a traffic officer directing you through. This ground asks for mercy rather than proving you wrong, so the hospital record or the officer's name carries all the weight.

Paragraph 4 lists the attachments, numbered and dated, in the same order you attach them.

Paragraph 5 is a ladder, and the word to notice is "alternatively". You ask for cancellation first, redirection second, fresh service third, and last, if all else fails, the chance to pay the discounted amount within 32 days of the outcome, which regulation 17(3) allows where the representation was made within the first 32 days. That ordering gives the officer something to grant even if the first request fails. Delete the rungs you do not want. Instalments are a separate application on form AARTO 04, not a representation.

Paragraph 6 tells the Agency where to send the outcome. Paragraph 7 confirms the contents are true. This letter is not itself an affidavit; the AARTO 08 form it is attached to carries the commissioner of oaths certificate.

A worked example

This example is illustrative only.

Jabu Khumalo runs a two-bakkie courier business in Germiston, in Ekurhuleni, which joined AARTO on 1 July 2026. An AARTO infringement notice arrives for a speed camera reading on a bakkie he sold and transferred two months before the date on the notice.

Jabu keeps ground 3.2 and deletes the others. Under 3.2 he gives the sale date and the buyer's name, and attaches the notification of change of ownership and the signed sale agreement. He completes form AARTO 08, has it commissioned, and attaches this letter, the vehicle registration papers, his identity document and the notice.

In paragraph 5 he keeps 5.1, cancellation, and 5.2, redirection to the new owner, and deletes 5.3 and 5.4, because he is not asking to pay anything. He uploads the bundle through the AARTO website and saves the reference number.

Change the facts: if the bakkie had still been his and a driver had signed it out that morning, Jabu's route would be a nomination on form AARTO 07 within 32 days, not this representation.

The mistakes that make one of these useless

Sending representations about a court matter. Nothing happens at the Agency, the court date arrives anyway, and you may end up dealing with a warrant. That costs more than the fine.

Paying first and arguing later. Payment usually closes the route completely, and no representation revives it.

Ticking every ground. Saying you were not the driver, and also that you sold the car, and also that the sign was obscured invites the officer to believe none of it.

Claiming you were not the driver without an affidavit. A bare letter is not evidence. The nomination is refused and the infringement stays yours.

Copying the notice details wrong. A mismatched notice number cannot be matched to a file, and silence looks exactly the same as refusal.

Keeping no proof of submission. Without a reference number, a stamped copy or a dated screenshot you cannot show you were inside the deadline, and the deadline is the one thing that is not arguable.

How to submit it and prove you did

Use the channel the notice specifies and no other, whether that is the Agency's online portal, an email address or a physical office. Put the letter and every attachment into one PDF, in the order of your paragraph 4 list, named with the notice number.

Then capture the proof immediately: the portal reference number, a dated screenshot, or a stamped copy if you handed it in. Diarise a follow-up two to three weeks out and send a short written query quoting the notice number and your reference. Silence is not a decision.

If it does not work

If the representation is refused, you are told the reasons and the amount now payable, including the R100 representations fee. Since 1 July 2026 there is no election to be tried in court on an AARTO notice. You may pay within 32 days, at the discount if you represented within the first 32 days, or lodge an appeal or review with the AARTO Appeals Tribunal within 30 days of receiving the reasons, on form AARTO 10A with a R200 fee. A Tribunal decision can be taken to a magistrates' court within 30 days. Read what is an enforcement order under AARTO before you decide, because ignoring the matter has consequences of its own.

Frequently asked questions

Does making representations cost anything?

Not to lodge, and you do not need an attorney; any police station commissions the AARTO 08 form free of charge. Under the AARTO Regulations, 2026 a R100 representations fee is added if the representation is refused.

I have already paid. Can I still make representations?

Usually not. Payment is normally treated as accepting the infringement. If you paid by mistake, say so in writing immediately and ask the Agency what it can do, but do not plan around it.

The notice went to my old address. What do I do?

Use ground 3.3 and ask, in paragraph 5.3, that the notice be served on you afresh so that you can exercise your options within the proper periods. Attach proof of your current address and say how and when you found out about the notice.

Do demerit points apply to my notice?

No. As at October 2026 the points system under the AARTO Act is not in force anywhere, so no points are recorded, even where a notice prints a points figure from Schedule 3. Confirm the current position with the Road Traffic Infringement Agency before you treat points as a reason to fight or to settle.

Can I use this for a fine from a municipal camera?

Only if the notice itself is an AARTO infringement notice naming the Agency. Municipal cameras issue under both systems. Check the paper, not the source.
